HHS Watchdog Slams OCR for Missed Cybersecurity Failures

Washington, D.C. – November 26, 2024- federal watchdog blasts OCR for failing to enforce HIPAA standards, risking millions of patients’ data during a massive spike in breaches.

A scathing report from the Health and Human Services (HHS) Inspector General (OIG) has revealed shocking lapses in cybersecurity oversight by the Office for Civil Rights (OCR).

The report accuses OCR of failing to enforce critical safeguards under HIPAA, exposing millions to potential health information breaches in a time when cybersecurity threats are surging.

According to the watchdog, OCR has failed to audit health entities adequately, evaluating only 8 of 180 HIPAA standards.

This oversight coincided with a staggering 239% rise in large breaches and a 278% increase in ransomware attacks, affecting over 88 million Americans in 2023 alone.

Highlighting a damning timeline, the OIG report revealed that after 2017, OCR stopped performing compliance audits entirely. Even when severe issues were identified, only three out of 70 noncompliant organizations were reviewed further.

OCR cited budgetary constraints as the reason for its inaction. In 2022, the office operated with only 60 investigators—an all-time low—while complaints about health data breaches surged to 51,779, marking a record high.

Melanie Fontes Rainer, OCR Director, defended the office, stating:

The OIG recommends urgent action, including expanding audit scopes and implementing stricter compliance measures to close gaping holes in healthcare data security.
